Terms and Conditions (GTC):

 

 

1 General:

1.1 The following General Terms and Conditions (GTC) serve as the exclusive basis for all business relationships between Lukas Maurer (hereinafter referred to as Aerolution) and the client. Deviating GTC of the client will not be recognized. These GTC also apply if Aerolution executes the delivery without reservation, even with knowledge of conflicting or deviating GTC of the customer.

1.2. Deviations from the provisions of the GTC are only permissible if this has been confirmed in writing.

 

2. Rights of use:

2.1 Unless otherwise agreed, upon full payment for the agreed-upon service, the client shall receive the exclusive, commercial, perpetual, and unrestricted right to use the image material as well as the right to pass it on to third parties.

2.2 The author retains the right to use and edit the recordings for their own promotional purposes, unaffected by this.

 

 

3.Liability:

3.1 Aerolution assumes no liability or costs for any damages incurred by the client as a result of the provided service, particularly through its publication.

3.2 If a commission cannot be carried out, or not fully completed, Aerolution shall not be responsible for any costs incurred by the client. This includes, but is not limited to, the following reasons: technical failure or defect of the aircraft or essential equipment, risk to life and limb, extraordinary events, force majeure (e.g. illness, accident, strike), and weather conditions.

It is explicitly pointed out that all flights can only be conducted in compliance with legally required conditions. Legal framework conditions may vary depending on the region/country. The following general guidelines are explicitly highlighted:

• No flight over crowds of people (maintain a distance of 100 meters) • No flight over residential properties (only with written permission from the property owner) • No flight over federal highways, waterways, and railway facilities, and maintain a lateral distance of 100 meters from such • No flight in snowfall, rain, or fog • No flight in excessively strong or gusty winds exceeding approximately 40 km/h (the pilot makes the decision) • No flight without visual contact of the pilot with the aircraft • Maximum flight altitude of 120m • The pilot always has the final authority in deciding whether to carry out a flight.

3.3 The client is responsible for obtaining, at their own expense, any approvals from property owners or those authorized to use the property regarding the take-off site and/or the overflight. Aerolution assumes as a basic premise that the client has obtained the written consent, particularly for aerial photos and videos, from the property owner / subject.

3.4 The client must adhere to the legal rest periods in the planning and ensure that they can also be adhered to during filming. The client is responsible for covering all damages resulting from non-compliance with rest periods (including to equipment and vehicles of Aerolution or their partners).

 

4. Payment:

4.1 The agreed-upon fee and any expenses are due immediately and without deduction upon delivery of the service. If additional costs arise for obtaining the ascent permit or special permits, the client shall generally bear these costs in full, even if the fee has been agreed upon as a lump sum and the additional fees were not foreseeable or estimable at the time of agreement.

Additional fees may particularly apply if the filming location is abroad or if an additional permit is required (take-off and landing site, nature reserve, flight in controlled airspace, etc.).

4.2 If a commission is canceled or postponed by the client, the following cancellation fees apply: From confirmation of the commission up to 48 hours before the start of the commission: 50%, up to 24 hours before the start of the commission: 70%, less than 24 hours before the start of the commission: 100% of the total costs. Plus all expenses, especially fees for permits and already booked travel expenses.

 

5. Contracts:

5.1. All production contracts, especially work contracts and non-disclosure agreements (NDA), must be concluded before the commission is confirmed. Contracts that are distributed on set or sent after filming should be considered generally ineffective.

5.2. Sending the daily schedule is understood as the commission confirmation at the very latest. The commission can also be informally confirmed through written confirmation of the order or by signing the proposal. Communication through platforms like WhatsApp is also considered written and legally binding. In specific cases, even confirming emojis (such as thumbs up, checkmark, etc.) can be considered as commission confirmation.

6.Jurisdiction:

6.1. The place of jurisdiction is Munich. Only German law applies. If a provision of the GTC is or becomes invalid, the rest of the contract remains unaffected. The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply.

6.2. The English version of GTC serves as a translation of the German GTC and is provided for reference purposes. The German version is the only valid and comprehensive version.

Wichtige Produktionshinweise für den Einsatz eines Multikopters:

• Der Start- und Landeplatz muss grundsätzlich vom Grundstückseigentümer schriftlich genehmigt werden!
• Luftaufnahmen fallen NICHT unter die Panoramafreiheit!
• In der Drehgenehmigung muss der Einsatz eines Multikopters ausdrücklich genannt sein.
• Kein Überflug + 100 Meter seitlicher Abstand insbesondere zu: (teilweise Ausnahmegenehmigung möglich*)
Menschenansammlungen (ab 12 Menschen)
Bundesfernstraßen / Bahnanlagen / Bundeswasserstraßen
Polizeistationen / Konsulate / Regierungsgebäuden / Verfassungsorgane
Krankenhäuser
Industrieanlagen / Anlagen zur Stromerzeugung & Verteilung
• Kein Überflug insbesondere von: (teilweise Ausnahmegenehmigung möglich*)
unbeteiligten Wohngrundstücken!
Personen
Naturschutzgebiete
• Für Dreharbeiten vor Sonnenaufgang bzw. nach Sonnenuntergang ist eine zusätzliche Genehmigung erforderlich.
• Fahraufnahmen mit Kraftfahrzeugen nur auf gesperrten Straßen!
• Stadien und Flugplätze (auch ehemalige Flugplätze, Militärflugplätze etc.) sind durch die Software für
den Multikopter gesperrt (der Kopter kann gar nicht abheben). Ist hier ein Dreh geplant (z.B. leeres
Stadium, gesperrter Flugplatz) gibt es die Möglichkeit diese sensiblen Orte frei zu schalten. Auch hierfür gilt: Vorlaufzeit beachten!
• Österreich: Kategorie A = unbebautes & unbesiedeltes Gebiet. Kategorie C = besiedeltes Gebiet.
• Die kompakten Systemdrohnen bzw. Kamera-Gimbalsysteme (DJI Mavic Air, Macvic 2, DJI
Inspire 1, DJI Inspire 2, Kamera: X5, X5R, X5s, X7) sind zwar extrem praktisch was die Handhabung angeht, erlauben einen schnellen Drehortwechsel, einen schnellen Auf- und Abbau und unkomplizierten Objektivwechsel. Allerdings gibt es bekannte Probleme der Systeme die gelegentlich bis selten auftreten können. Hierzu sind insbesondere folgende zu erwähnen: Keine 100% Farbwiedergabe durch fehlenden IR Cut Filter (Magenta Stich, vor allem in den Tiefen), je nach Drehort kann starkes Delay im Videosignal auftreten (Störquellen wie Funkmasten, WLAN, Eisen, eisenhaltiges Gestein etc.). Darüber hinaus insbesonders für die Inspire 2 mit X7 / X5S zutreffend: magenta Pixel, magenta Frames und schwarze Pixel in den Highlights im ProRes Material (kann während der Aufzeichnung nicht gesehen werden, tritt nur extrem selten auf), Verbindungsstörungen zwischen Drohne und Kamera bzw. Objektiv (Kamera oder Objektiv wird plötzlich nicht mehr erkannt, kann durch Landen und neu starten behoben werden= Zeitverlust). Sämmtliche Kameraeisntellungen verstellen sich (von PAL in NTSC), Codec etc.
• Mit einer Drohne kann man sehr viel realisieren, aber nicht alles! Oft kann die Drohne z.B. zusätzliche Fahraufnahmen überflüssig machen, sie wird aber nie einen Russian Arm ganz ersetzten können. Nahaufnahmen, absolut statische Aufnahmen etc. sind nicht immer mit einer Drohne realisierbar – die Drohne fliegt immer noch durch die Luft und deren Flugverhalten ist von vielen äußeren Faktoren abhängig.

Grundsätzlich gilt: Möglichst früh genau mitteilen wo der Multikopter fliegen soll, nur dann können wir den
Einsatzort überprüfen und ggf. eine weitere Genehmigung beantragen. Spontane Änderungen des Drehortes
können nach wenigen Metern schon dazu führen, dass wir unter Umständen nicht mehr fliegen dürfen.

*Die Auflagen beziehen sich auf die Rechtslage in Deutschland.

Wichtige Produktionshinweise für den Einsatz von Kamerafahrzeugen / geriggten Kameras

Fahraufnahmen (Mini X7- Rig, Towercam, Hybris etc.) dürfen wir grundsätzlich nur auf gesperrten

Straßen durchführen.

Fahraufnahmen mit geriggten Kameras (Außen oder Innen im Sichtbereich des Fahrers) dürfen nur auf

Gesperrten Straßen und von professionellen Fahrern durchgeführt werden.

Das kompakte X7- Rig / X5-Rig ist extrem praktisch und Effektiv was die Handhabung angeht,

erlauben einen schnellen Drehortwechsel, einen schnellen Auf- und Abbau und unkomplizierten

Objektivwechsel. Allerdings gibt es bekannte Probleme der Systeme die gelegentlich bis selten

auftreten können. Hierzu sind insbesondere folgende zu erwähnen: Keine 100% Farbwiedergabe durch

fehlenden IR Cut Filter (Magenta Stich, vor allem in den Tiefen), je nach Drehort kann starkes Delay

im Videosignal auftreten (Störquellen wie Funkmasten, WLAN, Eisen, eisenhaltiges Gestein etc.).

Keine Stufenlose Blende, kein ECS Shutter. Ganz selten: magenta Pixel, magenta Frames und

schwarze Pixel in den Highlights im ProRes Material (kann während der Aufzeichnung nicht gesehen

werden), Verbindungsstörungen zwischen Rig und Kamera bzw. Objektiv (Kamera oder Objektiv wird

plötzlich nicht mehr erkannt, kann durch Systemneustart behoben werden = Zeitverlust). Sämtliche

Kameraeinstellungen verstellen sich (von PAL in NTSC), Codec Weißabgleich etc. (trifft insbesondere

bei dem 9mm Laowa Objektiv auf).
