Terms and Conditions (GTC):
1.1 The following General Terms and Conditions (GTC) serve as an exclusive basis for all business relations between Lukas Maurer (hereinafter referred to as Aerolution) and the client. Deviating terms and conditions of the customer are not accepted. These terms and conditions shall also apply if Aerolution carries out the delivery unconditionally in the knowledge of conflicting or deviating terms and conditions of the customer.
1.2. Deviations from the provisions of the GTC are only permissible if this has been confirmed in writing.
2. Rights of use:
2.1. Unless agreed otherwise, the customer shall receive the exclusive, commercial, unlimited and unlimited right of use of the picture material as well as the right to pass on to a third party with the full payment of the agreed service.
2.2. Notwithstanding this, the author is entitled to use and edit the recordings for his own advertising purposes.
3.1. Aerolution assumes no liability or costs for damage caused to the client by the services provided and in particular by their publication.
3.2. If an order can not be executed, or not completely, Aerolution will not bear any costs incurred by the customer. In particular, the following reasons apply: technical failure or defect of the aircraft or essential accessories, danger to life and limb, extraordinary events, force majeure (e.g. illness, accident, strike) and weathering.
In particular, it is pointed out that all flights can only be carried out in compliance with the statutory requirements.
The legal framework can vary by region / country. The following general guidelines are explicitly stated:
- no overflight of residential premises (only with the written permission of the land owner)
- no overflight of federal roadways, waterways, railway lines and hospitals as well as 100 meters lateral distance to such
- no overflight of crowds of people (+ 100 meters lateral distance)
- no flight in case of snowfall, rain or fog
- no flight in case of excessive or gusty winds above 40 km / h (the pilot decides)
- no flight before sunrise or after sunset (special permit required)
- no flight without visual contact of the pilot to the aircraft
- maximum flight altitude 100m (Germany), 150m (Austria)
- the pilot always decides as the last instance about the realization of a flight
3.3 The client has to collect any permits from landowners or their beneficiaries with regard to the starting place and / or the overflight at their own expense. Aerolution assumes in principle that the client has obtained the written consent of the land owner, especially for photo and film footage from the air.
4.1. The agreed fees and, if applicable, the expenses are due immediately upon delivery of the service and without deduction. If additional costs for the granting of the ascent permit or special permits are incurred, the customer has to bear these costs in full, even if the fee was agreed as a lump sum and at the time of the agreement the additional fees were not predictable or assessable.
Additional charges may be incurred in particular if the location of the film is abroad or if, for example, an additional permit is necessary (nature reserve, night flights, etc.).
4.2. If an order is canceled by the customer, the following claims are entitled: Up to 48 hours before the start of the order 50% of the salary, up to 24 hours before the start of the order 70% of the salary.
5.1. The court of jurisdiction is Munich. Only German law applies. If a provision of the GTC is or becomes inadmissible, the remainder of the contract shall remain unaffected. The provisions of the United Nations Convention on Contracts for the International Sale of Goods shall not apply. The full validity is limited to the German GTCs.
